Privacy Notice and Cookie Policy
Information on the processing of personal data of users of the website pursuant to Article 13 of EU Regulation 679/2016
This document has been prepared in accordance with Article 13 of EU Regulation 2016/679 (hereinafter: "Regulation") in order to allow users to become aware of our privacy policy, to understand how their personal information is managed when using our website www.ekis.it (hereinafter "Site"), and, if necessary, to give their express and informed consent to the processing of their personal data. The information and data provided by users or otherwise acquired in the context of the use of the Site's browsing services (hereinafter "Services") will be processed in compliance with the provisions of the Regulation and the confidentiality obligations that inspire the activities of EKIS S.R.L. In accordance with the Regulation, the processing carried out by EKIS S.R.L. will be based on the principles of lawfulness, fairness, transparency, purpose limitation, data minimization, accuracy, integrity, and confidentiality, as well as the principle of accountability under Article 5 of the Regulation.
1. DATA CONTROLLER AND DATA PROTECTION OFFICER (DPO)
The data controller is the company EKIS S.R.L., with registered office at Via Fausto Coppi, 12 - Reggio Emilia (RE - 42123) - VAT: 01882890351, represented by Livio Sgarbi, legal representative.
The Data Controller, not falling within the cases indicated in Article 37 of the GDPR, nor in those indicated in the various interpretations of the Data Protection Authority, did not consider it necessary to appoint a Data Protection Officer.
2. PERSONAL DATA SUBJECT TO PROCESSING

The personal data subject to processing may consist of an identifier such as an identification number, name, surname, company of affiliation, and a geographical reference.

The personal data subject to processing may consist of an identifier such as an identification number, an online identifier, or one or more characteristics suitable for identifying the data subject, depending on the type of services requested.
In particular, the personal data processed through the Site are as follows.
a) Browsing data
The computer systems and software procedures used to operate the Site acquire some information automatically during normal operation, the transmission of which is implicit in the use of Internet communication protocols. These are not collected to be associated with identified data subjects, but by their very nature could, through processing and association with data held by third parties, allow users or browsers to be identified. This category includes information such as IP addresses, domain names of computers used by users who connect to the site, URI (Uniform Resource Identifier) addresses of the requested resources, time of request, method used in submitting the request to the web server, size of the file obtained in response, numerical code indicating the status of the response given by the web server (successful, error, etc.), and other parameters related to the user's operating system and computer environment. This data is used solely for the purpose of obtaining anonymous statistical information on the use of this website and to check its correct functioning, to identify anomalies and/or abuses, and is deleted immediately after processing. The data may be used to ascertain responsibility in case of hypothetical computer crimes against the site or third parties.

3. PURPOSES OF PROCESSING
The personal data of users will be processed for the following purposes:
3.1 to enable navigation of the Site and the provision of services made available by the Data Controller, including the management of Site security;
3.2 to comply with any obligations required by current laws, regulations, or EU legislation or to respond to requests from authorities;
3.3 for the compilation of statistics, without it being possible to identify the data subject.
4. LEGAL BASIS AND MANDATORY OR OPTIONAL NATURE OF PROCESSING
The legal basis for the processing of personal data for the purposes set out in section 3.1 is Article 6.1.b) of the Regulation, as the processing is necessary for the provision of services or to respond to the data subject's requests. The legal basis for the processing of personal data for the purposes set out in section 3.2 is Article 6.1.c) of the Regulation ("processing is necessary for compliance with a legal obligation to which the data controller is subject"). The provision of personal data for these purposes is optional, but failure to provide it would result in the impossibility of activating the requested services. It is specified, however, that the processing referred to in section 3.3 is not carried out on the basis of personal data and, therefore, may be freely carried out by the Data Controller.

5. RECIPIENTS OF PERSONAL DATA
The personal data collected may be shared, for the purposes set out in section 3 of this privacy notice, with:
5.1. subjects who typically act as data processors under Article 28 of the Regulation, i.e., subjects who cooperate with the Data Controller to achieve the purposes set out above, including subjects delegated to carry out technical maintenance activities.
5.2. subjects, entities, or authorities to whom the communication of personal data is mandatory pursuant to legal provisions or orders from authorities;
5.3. persons authorized by the Data Controller, pursuant to Article 29 of the Regulation, to process personal data necessary to carry out activities strictly related to the provision of services, who have undertaken to maintain confidentiality or are otherwise under a legal obligation of confidentiality.
6. DATA RETENTION
Personal data processed for the purposes set out in section 3.1 will be retained for the time strictly necessary to achieve those purposes. In any case, as these are processing operations carried out to provide services, the Data Controller will retain personal data for the period of time provided for and allowed by Italian law to protect its interests (Article 2946 of the Italian Civil Code and subsequent amendments).
Personal data processed for the purposes set out in section 3.2 will be retained until the time provided by the specific obligation or applicable law.
7. RIGHTS OF DATA SUBJECTS
As data subjects, the individuals referred to in point 3) enjoy the rights provided for in Articles 15, 16, 17, 18, 19, 20, 21, and 22 of the GDPR. In detail:

- Right to erasure ("right to be forgotten")
- Right to restriction of processing
- Right to notification in case of rectification or erasure of personal data or restriction of processing
- Right to data portability
- Right to object
- Rights related to automated decision-making concerning individuals, including profiling
